Foedera ("Foedera," "we," "us") operates a marketplace at foedera.com that connects owners of construction and heavy equipment ("Owners") with people and businesses who want to rent that equipment ("Renters"). Foedera Corporation is a Texas corporation.
By creating an account, listing equipment, or booking a rental through Foedera, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the platform.
You must be at least 18 years old and able to form a binding contract to use Foedera. If you're using Foedera on behalf of a company, you're confirming you have the authority to bind that company to these terms.
Foedera provides the platform that connects Owners and Renters. We are not a party to the rental agreement formed between an Owner and a Renter, we do not own, inspect, or operate the equipment listed on the platform, and we are not a rental company ourselves. Owners are solely responsible for the accuracy of their listings, the condition and safety of their equipment, and having the legal right to rent it out. Renters are solely responsible for operating equipment safely, following all applicable laws and manufacturer instructions, and for any damage, injury, or loss arising from their use of the equipment.
You're responsible for keeping your account credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized use of your account.
Listings show daily, weekly, and monthly rates set by the Owner. A booking total may also include:
A booking request is not confirmed until the Owner accepts it. Owners may decline any booking request.

The damage waiver is an optional product Renters may purchase at booking. Payments are processed by Stripe. Foedera does not store your full payment card details. By making a booking, you authorize Foedera to charge your payment method for the amounts described in your booking confirmation, and to hold and later release a security deposit.

Foedera provides the platform "as is" and "as available," without warranties of any kind, express or implied. We don't warrant that the platform will be uninterrupted, error-free, or secure, and we don't warrant the condition, safety, or suitability of any equipment listed.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
